Welcome to AX Nutrition. These Terms of Use ("Terms") govern your access to and use of the AX Nutrition mobile application and related services (collectively, the "Service"). The Service is operated by AthleanX ("we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials secure and confidential
• Notify us immediately if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

AX Nutrition is a nutrition tracking and fitness application that provides:

• AI-powered food photo analysis to estimate nutritional content
• Body composition analysis from user-uploaded photos
• Personalized daily calorie and macro-nutrient goals
• Meal logging and nutrition tracking
• Hydration tracking
• Weight and body composition trend tracking
• Barcode scanning for packaged food items

4. Subscriptions and Payments

4.1 Auto-Renewable Subscriptions

The Service offers auto-renewable subscription plans to access premium features. Available plans include:

• Monthly Subscription: Billed monthly at the current listed price
• Annual Subscription: Billed annually at the current listed price

Prices are displayed in the app and may vary by region. All prices are in USD unless otherwise indicated.

4.2 Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee. Free trial eligibility is limited to one trial per user.

4.3 Billing and Renewal

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase
• Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• You can manage and cancel your subscriptions through your Apple App Store or Google Play Store account settings

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your device's subscription management settings. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. Refunds are handled by the Apple App Store or Google Play Store in accordance with their respective policies.

5. User Content

You may upload content to the Service, including food photos, body photos, and personal health data ("User Content"). You retain ownership of your User Content. By uploading User Content, you grant us a limited, non-exclusive license to use, process, and analyze your content solely for the purpose of providing the Service to you.

You are responsible for ensuring that your User Content does not violate any applicable law or infringe on the rights of others. We reserve the right to remove any User Content that violates these Terms.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit harmful, offensive, or inappropriate content
• Create multiple accounts to exploit free trials or promotional offers
• Use automated tools, bots, or scrapers to access the Service
• Resell, redistribute, or sublicense access to the Service

7. Intellectual Property

The Service, including its design, features, code, AI models, food database, and all related content, is owned by AthleanX and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

The AthleanX name, logo, and all related trademarks are the property of AthleanX. You may not use these marks without our prior written permission.

8. Health and Medical Disclaimer

The Service is not a medical device and does not provide medical advice. All nutritional information, body composition estimates, calorie goals, and fitness recommendations provided by the Service are estimates for informational purposes only.

• AI-powered photo analysis provides estimates that may not reflect exact nutritional values or body composition
• Calorie and macro-nutrient goals are calculated using general formulas and may not be suitable for your specific health needs
• The Service is not a substitute for professional medical advice, diagnosis, or treatment
• Always consult a qualified healthcare provider before making changes to your diet or exercise routine
• If you have an eating disorder or a history of disordered eating, please consult a healthcare professional before using this Service

You use the Service and its recommendations at your own risk. We are not liable for any health-related outcomes resulting from your use of the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components
• We do not guarantee the accuracy of nutritional estimates, body composition analyses, or any other data provided by the Service
• In no event shall AthleanX be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless AthleanX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated data
• Sections of these Terms that by their nature should survive termination will remain in effect (including Limitation of Liability, Indemnification, and Governing Law)

You may terminate your account at any time by deleting your account through the app or by contacting us at support.athleanx.com.

12. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will update the "Last updated" date at the top of this page
• For material changes, we will notify you through the app or by email
• Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms

If you do not agree with the updated Terms, you should stop using the Service and delete your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

14. Third-Party Services

The Service may integrate with or rely on third-party services, including but not limited to:

• Apple App Store and Google Play Store for payments and subscriptions
• Third-party authentication providers (e.g., Google Sign-In, Apple Sign-In)
• Cloud infrastructure and AI processing services

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party services.
